At the EU level, two new guidelines are in force to prevent misleading or false communication with environmental claims: the Empowering Consumers Directive (EmpCo, already adopted) and the Green Claims Directive (still in the legislative process). German case law is increasingly concerned with cases of unfair competition, examining whether consumers or business partners are being deceived by misleading 'sustainable' claims or product seals. This development is causing uncertainty among many companies regarding how they can demonstrate their commitment to sustainability in a legally compliant manner.
At first glance, no communication ('greenhushing') may seem to be the easiest way to avoid greenwashing. However, clear and transparent sustainability communication offers strategic advantages that are lost in the process. Furthermore, greenwashing also carries the risk of reputational and trust damage.
The balance between greenwashing and greenwashing can only be achieved if transparency and credibility underpin your communication strategy. Only in this way can holistic communication be created that is in harmony with your corporate strategy — the basis on which to build trust and exploit the opportunities of your commitment to sustainability clearly and authentically.
